ARC card. UK Work Permit for 2 years
Oksana, a young woman from Russia, contacted us. She applied for asylum through a charity organization. However, she was NOT allowed to work in the ARC – Application Registration Card.
The ARC card is issued to all applicants for asylum in the UK for up to 2 years while the case is being considered. They are called Asylum Seekers in the UK. They can get a work permit with an ARC card, depending on how they applied for asylum:
- after which type of visa they were applied for,
- what were the conditions of that visa at the time of application,
- whether the visa was expired or not.
If the ARC card holder has received this card, as well as a Home Office decision with a mark on the card with the decision that he is not allowed to work, then the asylum applicant has the right to apply for a work permit after 10-12 months in the UK.
Oksana did not have an official work permit on her ARC card. I wrote an official letter to the Home Office with a reference to the UK law so that she would be given a work permit. We sent this letter at a time when she had been in the country with the ARC card for 10-11 months.
The decision on a work permit is made for a very long time – from 3 to 6 months. In Oksana’s case, we wrote a letter in February, and she received permission on July 14, in 4.5 months.
A work permit is issued only for those jobs where there are shortage occupations. Professions such as: Care for the elderly (Care Workers), on construction sites, etc.
