How to get a UK Spouse Visa under Family Members after 2 times refusal?

Client’s situation

Bek is from Uzbekistan originally and entered the UK in September 2020 as a student of a University according to the General Student Tier 4 visa. 

While studying he has met his partner Kate who is an EU citizen and has pre-settled status. They decided to register their marriage in the UK on 24 January 2022. After registration of their marriage Bek has applied 2 times for EU Pre-Settled Status and has received 2 times refusal. 

The reason for refusal was that Bek is confused between Family Permit EU and Family Members visa Applications.  He was just thinking if his partner is an EU citizen with pre-settled status he is eligible to apply for the EU Family Permit scheme. However, he did not consider that they have registered their legal relationship after 2020. Therefore he cannot apply anymore for the EU Family Permit scheme.

Solution and result

On 10 August 2023 I made for Bek the right Application under Family Members (FLR M) and ordered priority service for decision making within 1 week. And on 14 August 2023 he got the positive decision of Spouse visa for 2,5 years with a full right of working and travelling.
